I see you have an 09 and yes you can have a fulty switch. It will be covered under warrenty.

I had mine go 2 weeks after I bought my ZX-12R and there was only 2700 miles on it. Found out it was an issue with the 00-02 bikes. They either went in the first 4000 miles or not at all.
