last week i was involved in a car accident, actually my fault(but not really, IMO). here's the story:

i was driving home from school on a small backstreet. not going fast at all i'd say between 25-30 mph. on these streets there are stop signs every and they are visible, it has the markings on the street as well. but here's where everything turns to shiet. on this crossection there is not white street marking, and the stop sign is covered by a tree. so i'm approaching the intersection when BEHOLD there IS A STOP SIGN. note before approaching the crossection i sped up a little. continuing... the next thing i know i see a ugly looking chevrolet and me about to hit it. F&&&!!!!!! tried to stop but couldn't as it was too close to stop. BOOOOOOM!!!!

i jumped, my bike went in the direction of the other car and i went in the same direction. i went east, the bike went south.

the first thing i notice is my left foot. its numb and i see something bulging from it. from what i recollect - my tibia hit the windscreen and now i have a fractured tibia but thats' just a theory, maybe i jumped successfully but the impact of the fall fractured it too. who knows?

i just wish i had protective pants to save me from the wretched road rash which sucks. as for my tibia, its a different story. i was put on a splint for the first week, then yesterday i went back to the doctor and he tells me that it hadnt healed correcly, instead of pulling back together they had seperated - so now i have a cast that halfway between my pelvis and thigh.
he says if it still doesnt heal correctly, i'll need surgery for it - he prefers the surgery to the cast because the cast is so uncomfortable.

**** - there's so many things i'd wish i would've done differently. but i believe it was destined to happen. hey, it could've been worse.

Sorry about getting smacked down. Do yourself a favor and have someone take pictures of the foilage that covers the stop sign. It may help you in the event you decide you need an attorney to help you out.

Glad you are still breathing, bummer about the bike and your pain!

OH HELL NO !!! i would be after the cities ass big time for that. GO GET PICTURES TOMORROW ASAP !!!!!!!!!!!!!!!!!!!!!!!!!! then get a good bike attorney and kick there ass's !!!!!! :evil:

Down!

Down for now, but getthe pictures of the street and sign. Better to try than to just go through thewhole painful mess without some compensation. I have plates and screws in my lower left leg, both bones 3 breaks...reset it myself and the next day the operated...most embarrassing...It happpended on ice while carrying a 16" log for the fireplace... I just hope that the lesson learned is to expect stopsigns and ALWAYS give the right-of-way to a larger vehicle, even if they don't have it...be prepared!

yeah, i got the pictures the day after it happened. i dont know that a lawyer can do anything, because my dad talked to some lawyers and they say it's very hard for the courts to take up something like that against the city.

anyway, for those of you who have gone to court(car accident or otherwise) what happends? i've never been to court before in my life? should i get a lawyer or no?

IF ou go forward

IF you decide to go forward then YES, because the City will use its City Prosecutor in court...I know, My wife works for one that just retired as the City Prosecutor...now he makes money going to court representing the clients, and not defending the city. It's not that difficult to beat the city. It happens ALL the time. Of course this one has been practicing law for over 50 years in this town...but even with all the laws, statutes...he has my wife to look up the exact statutes and presents them in court...you CAN beat City Hall if you have an attorney worth his salt. If it was a new bike, you had injuries, and you want to go forward...or if you just want to let it go...it's all up to what you want to do...There should be an attorney that you can talk to that will tell you which atorney in town or your county is the best for the type of action that you are going for. Some specialize in divorce, some in consumer fraud some will specialize in what you need...

sorry to hear about the wreck and glad to hear you're alright. hope that leg heals good for you. good luck with the court. even if you can't go after the city, use the pics to prove that the accident wasn't you're fault so you're not stuck with the insurance premiums.

yeah i'm not interested in going after the city, i just want to put that behind me. i have better things to think about, like school.

Sorri about your accident. I hope you recover quickly and get back on a bike again. My prayers are with you!!!!!

Anything can happen on a bike. You have to watch out for all the 4 wheelers, the road and the 18 wheelers.

Keep your whits 8) about you and ride safe!!!!!!
